Terms and Conditions
BOOKINGS
1.1 – Booking’s will be confirmed within 24 hours of receiving payment in writing.
1.2 – Confirmed Bookings, once written confirmation has been received with the deposit payment you can then consider your booking confirmed. Bookings made within 7 days of departure require full payment at the time of booking.
1.3 – Booking payments are to be made via bank transfer once your invoice has been received. 25% deposit is required on booking and then the final balance will be due 24 hours prior to departure.
1.4 Deposits are due to be paid within 24 hours of receiving the invoice. Once the deposit has been paid and cleared then your booking confirmation will be sent out to you.
1.5 – Cancellation by client – Must be confirmed in writing. Cancellation charges may apply. If cancellations are made within 24 hours of departure there will be no refund issued. Any cancellations made prior to 24 hours of departure will lose the deposit. Cancellation by South Coast Water Taxis – We will only make a cancellation if we deem the weather to be too dangerous to sail. If we cancel prior to departure then you will receive a full refund. You will receive a cancellation notice prior to 24 hours to departure.
1.6 – Changes to your booking – If you need to change the date / departure time of your booking South Coast Water Taxis will do their absolute best to accommodate you. Please note that an admin fee may apply.
Acceptance Of Risk
2.1 – Powerboat activities involve inherent risks including, but not limited to, collision, capsize, falls, weather exposure, mechanical failure, and injury.
2.2 – By participating, the Client and all Passengers acknowledge and voluntarily accept these risks.
Fitness of the client
Medical
3.1 – The Client must disclose any medical conditions, disabilities, injuries, pregnancy, or medication that may affect safe participation prior to departure.
3.2 – South Coast Water Taxis reserves the right to refuse participation to any person deemed unfit or unsafe.
Safety Instructions
4.1 – The Skipper will be giving a safety briefing & Instructions prior to departure.
4.2 – All Passengers must comply immediately with instructions given by the skipper or Crew at all times.
4.3 – Failure to comply may result in termination of the charter without refund. Alcohol, Drugs & Behaviour
5.1 – No passenger may be under the influence of alcohol or drugs that impair judgement or coordination.
5.2 – The Company may refuse boarding or terminate the charter if behaviour is unsafe, abusiveI
5.3 – Aggressive, reckless, or disruptive behaviour will not be tolerated.
Personal Protective Equipment (PPE)
6.1 Approved lifejackets/buoyancy aids must be worn when instructed or at all times where required by law.
6.2 It is the Passenger’s responsibility to ensure correct fit and proper use of PPE provided.
Weather and Sea Conditions
7.1 Taxi Trips are subject to suitable weather and sea conditions.
7.2 The Company reserves the right to delay, amend, or cancel a charter for safety reasons.
7.3 No liability is accepted for inconvenience or losses arising from weather-related decisions.
Children
8.1 Children must be supervised at all times by a responsible adult.
8.2 Minimum age, height, or weight restrictions may apply.
8.3 The Client is responsible for advising South Coast Water Taxis of ages so that we can make sure to have the correct age safety wear.
Personal Property
9.1 Personal belongings are carried at the Passenger’s own risk.
9.2 The Company accepts no responsibility for loss or damage to personal items.
Damage and Liability
10.1 The Client is responsible for any damage to the Vessel or equipment caused by negligence, misuse, or failure to follow instructions.
10.2 South Coast Water Taxi’s liability for injury or loss is limited to the maximum extent permitted by law.
Indemnity
11.1 The Client agrees to indemnify South Coast Water Taxis against claims, losses, or damages arising from their actions or the actions of their guests.
Insurance
12.1 South Coast Water Taxis maintains appropriate vessel and public liability insurance as required by law.
12.2 Passengers are strongly advised to hold their own personal accident and travel
insurance.
Emergency Procedures
13.1 In an emergency, Passengers must follow Crew instructions immediately.
13.2 Emergency equipment is carried onboard and must not be tampered with.
Photography
14.1 – Permission to Photograph – By boarding the vessel, guests acknowledge and agree that photography and/or videography may take place during the charter.
14.2 – Ownership of Images All photographs and video footage taken by the charter company or its designated photographer remain the sole property of the charter company/photographer, unless otherwise agreed in writing.
14.3. Use of Images The charter company may use images and footage for:
● Marketing and promotional purposes
● Website, social media, and advertising materials
● Printed or digital media
No compensation is owed to guests for such use.
14.4. Guest Consent & Release Guests grant permission for their likeness, image, and voice to be captured and used without restriction. This includes adults and minors under the responsibility of a parent or legal guardian.
14.5. Opt-Out Option Guests who do not wish to be photographed must notify the crew or photographer before departure. Reasonable efforts will be made to avoid capturing or using their image.
14.6. Personal Photography Guests are welcome to take personal photos and videos for private, non-commercial use. Commercial use (including influencer, brand, or promotional content) requires prior written approval from South Coast Water Taxis.
